OCI card for children born abroad: eligibility, process and uses
Children born outside India to at least one Indian-origin parent are eligible for OCI (Overseas Citizen of India) status. OCI gives lifelong visa-free entry to India, the right to study in Indian schools and universities, and the ability to hold NRE accounts and purchase non-agricultural property in India. A new OCI card is needed at each passport renewal until age 20.
Apply within the child's first year for the smoothest process
Any child born outside India to at least one parent who is, or was, an Indian citizen is eligible for OCI. Apply at the Indian Consulate or High Commission in your country using the child's birth certificate, passport and the parent's OCI card or Indian passport. OCI gives the child lifelong visa-free India entry, right to study and right to work in India.
Key points
- Apply when passport is issued — Most NRI parents apply for OCI when the child's first foreign passport is issued — do it before the child's first India visit.
- Renew with each passport until age 20 — OCI card must be reissued when the child's passport is renewed — each time until the child turns 20, after which it is permanent.
- OCI rights in India — OCI gives lifelong visa-free India entry, right to study (including IITs and IIMs on the general merit list), right to work and right to purchase non-agricultural property.
OCI eligibility for children born abroad
A child is eligible for OCI if at least one parent is or was an Indian citizen — regardless of whether the parent now holds foreign citizenship.
If the parent holds OCI: the child is eligible for OCI.
If the parent holds a foreign passport with Indian-origin ancestry: the child is still eligible.
Exceptions: children of Pakistani or Bangladeshi nationals are not eligible for OCI, regardless of Indian-origin ancestry.
Application process
Step 1: Gather documents — child's foreign passport (original + copy), child's birth certificate, parent's OCI card (if applicable) or Indian passport/PIO card, parent's current foreign passport, 2 recent photos of the child (standard passport-size).
Step 2: Apply online at ociservices.gov.in — fill in the application, upload documents and pay the fee.
Step 3: Submit the physical application (original documents) at the Indian Consulate or High Commission in your country or through the designated outsourced service (BLS, VFS, etc.).
Step 4: OCI processing takes 4–12 weeks depending on the country. Track online using the application reference number.
Renewal: reissue OCI when the child's passport is renewed — until the child is 20. After 20, one final reissue is done and thereafter no renewal is required.
Frequently asked questions
Can a child born in a country that grants citizenship by birth (jus soli) hold both OCI and that country's citizenship?
Yes. OCI is not citizenship — it is a special status. A child can hold a foreign passport plus OCI status simultaneously. OCI does not conflict with the foreign citizenship.
Can an OCI child attend a government school in India?
OCI children are treated at par with Indian citizens for school admissions (both private and government). They are also eligible for central government medical and engineering entrance exams (NEET, JEE) on the general merit list.
What if one parent loses Indian citizenship after the OCI application?
The child's OCI is not affected by a parent's subsequent citizenship changes — eligibility is determined at the time of application and is not revoked if the parent naturalises later.
